The EPA has recently been given the right to revoke mining permits of mining companies to protect sensitive ecosystems. It was a unanimous decision made by a three-judge panel in the federal appeals court. They concluded that the “Clean Water Act and Congressional intent” stipulated that this be permissible. The EPA was denied this ability in 2012 on the grounds of that this right was unconstitutional. This decision also works retroactively. This means that prior “unconstitutional” revocations are now in effect.
